1. Services

EverWebb offers web design, branding, digital marketing, and related services as outlined in individual project agreements or proposals. Specific deliverables, timelines, and pricing will be detailed in a signed contract before work begins.

2. Project Scope

• Changes or additions to the agreed-upon scope of work will require a new agreement or additional fees.
• Any content (text, images, etc.) must be provided by the client in a timely manner to avoid delays.

3. Payment Terms

• A non-refundable deposit of 30% is required to commence work.
• Remaining balances are due as outlined in the project agreement.

4. Intellectual Property

• Upon full payment, the client owns the rights to the final website and deliverables.
• EverWebb retains the right to showcase completed projects in our portfolio and marketing materials unless agreed otherwise.

5. Hosting and Maintenance

• Hosting and maintenance are not included unless explicitly stated in the agreement.
• EverWebb is not responsible for downtime, data loss, or server issues unless part of a hosting/maintenance agreement.

7. Timelines

• Project timelines are dependent on client responsiveness. Delays in providing necessary feedback or materials may result in a rescheduled delivery date.
• Rush projects may incur additional fees.

8. Liability

• EverWebb is not liable for any damages or losses arising from the use of our services, including but not limited to technical issues, hacking, or third-party software failures.
• The client is responsible for ensuring compliance with applicable laws, including copyright and licensing for materials provided to EverWebb.

9. Termination

• Either party may terminate the agreement with 30 days’ written notice.
• Fees for completed work and non-refundable deposits remain due upon termination.

10. Dispute Resolution

• Any disputes will be resolved in accordance with the laws of New York.
• In the event of legal action, the client agrees to cover any associated legal fees incurred by EverWebb.

11. Updates to Terms

EverWebb reserves the right to update these Terms & Conditions at any time. Continued use of our services constitutes agreement to the updated terms.
